"10/21/2024 RE: Unaddressed Mold Condition at 1517 Carraway Ct., Colorado Springs, Colorado Dear Sirs, I am writing to place you on notice that, pursuant to Colorado’s Warranty of Habitability Law CRS … Read More§38-12-505 the single- family, residential home we are leasing, located at 1517 Carraway Court, Colorado Springs, Colorado 80907 (the “Residence”), contains “uninhabitable conditions” within the meaning of CRS §38-12-505 that, despite repeated notices and requests, have continued to remain unaddressed by Springs Homes for Rent (“Management”) thereby creating unhealthful and dangerous living conditions for my family and me. On Monday, October 14, 2024, I contacted Management’s office to report “significant and visible mold identified and present in the kitchen of the Residence”, originating from incomplete repairs performed by a contractor, engaged by Management, giving rise to water penetrating kitchen cabinetry under and near the kitchen sink. My wife, J———- R———, provided pictures of such mold to Management, specifically Diana, on Tuesday, October 15, 2024, following which a documented “claim”, as per your protocol, was not apparent on the Management “portal”. As a result, and given the urgency of the matter, I opened a “claim” on the Management online portal” on Wednesday, October 16, 2024, providing Management with sufficient notice to schedule an inspection of the Residence to assess the mold reported; by Saturday, October 19, 2024, Management had still failed to respond. Due to the delay in Management response, and in the interests of preserving safety inside the Residence, we attempted to cover the affected areas to reduce our exposure to the mold however, water continues to penetrate through the unfinished repairs further contributing to mold growth under the sink and cabinetry. We did, however, receive an email from Management, dated October 17, 2024, stated that if a mold test is performed by Management and the results are negative for the presence of mold, we, the tenant, would be responsible for the cost of such testing. This is not a response that addresses the urgency of this matter, nor is it a policy consistent with the protections provided and intended by Colorado’s Warranty of Habitability Law. Also, in according with Colorado State law management is required to inspect any mold claims within 96-hours of notification by a tenant. As of the date of this letter, it has been one (1) week since we reached out to Management for assistance and placed you on notice and no action has been taken to resolve this mold condition. After more than six (6) years of tenancy at the Residence, it is disheartening that Management has failed to address and remedy this serious threat to our health and the health of our three (3) young daughters who are particularly susceptible to health issues related to mold. Given the circumstances, and the need to assure the safety of our family, we are placing you on notice that, based upon Management’s breach of the Colorado Warranty of Habitability and your obligations therein, we consider our lease agreement to be “constructively terminated” by Management, for the Residence located at 1517 Carraway Court, Colorado Springs, Colorado 80907 and, as a result of such “constructive eviction”, when we vacate the Residence, all liabilities that we may have attendant to such lease agreement will cease. We request a written acknowledgment of this letter and confirmation of the timing of the return of our security deposit under the lease. Thank you for your attention regarding this very serious matter, and our hopes that we can handle this situation in an amicably manner without the formal involvement of counsel. Sincerely, We sent this letter and they are still trying to charge us rent for the month of November and still haven’t sent someone to remediate the issue, but they did someone out to find that it is a positive test for mold just like we thought.
